CONTEXT
There is one question underneath every off-plan decision in Dubai, and most buyers are too polite or too unsure to ask it directly. What happens to my money if the building never gets finished? It is the right question. And the answer is more structured, and more verifiable, than most international investors realise. Dubai did not leave this to trust. It built a system, and more importantly, it built a system you can check yourself, without relying on anyone's word, including mine.
MY TAKE
Start with the mechanism most people have heard of but few actually understand: the escrow account. When you buy off-plan in Dubai, your money does not go to the developer. That is the single most important sentence in this entire subject. Under Law No. 8 of 2007, every registered off-plan project must route buyer payments into a dedicated escrow account, controlled by a government-approved trustee, not by the developer. The developer cannot simply withdraw it. Funds are released to them in stages, and only as verified construction milestones are actually completed. Read what that means in practice. The developer only gets paid for work already done. Your capital is not funding a promise. It is funding progress that has been independently confirmed. If the developer stops building, the money stops flowing. The incentive is structurally aligned with delivery, because under this system, the fastest way for a developer to get paid is to build.
MY THESIS
Now here is the part that separates an informed buyer from a hopeful one, and it is something you can do from your phone before you ever sign anything. You do not have to take a developer's word, or an agent's word, that a project is registered and protected. You can verify it yourself through the Dubai REST application, the official platform of the Dubai Land Department. Open the "Project Status" service, and you can see whether a project is officially registered, its escrow account status, its construction progress percentage, and whether it is active, on hold, or cancelled. Two minutes, and the single biggest risk in off-plan buying becomes something you have personally confirmed rather than something you were told. And the protection does not end at the escrow account. If a project is ever formally cancelled by the regulator, there is a defined legal process for returning buyer funds, overseen since 2020 by a dedicated judicial committee for exactly these cases. The retention percentages people fear, the thirty or forty percent kept on a buyer default, do not apply when the regulator cancels a project. That is a different scenario entirely, and the law treats it differently. So layer the protection as it actually exists. The escrow account holds your money outside the developer's reach. The milestone system ties every release to verified work. The Dubai REST app lets you confirm all of it yourself, in real time. And the legal framework stands behind you if the worst ever happens. That is not blind trust. That is a system engineered so that trust is not even required. This is also why the developer question matters so much, and why I keep returning to it. The framework is broadly the same across every registered project. So the real decision was never whether the system protects you. It does. The real decision is which developer, with which track record, you want to be building against that protection. The escrow account defends your capital. The developer's record determines whether you are waiting on a timeline or a disappointment.
FINAL THOUGHT
The safest thing you can do before an off-plan purchase in Dubai is also the simplest. Open the Dubai REST app, check the project status, confirm the escrow and the construction progress with your own eyes. The system was built to protect you, and it was built to be checked. An investor who verifies is not being cautious. He is using the exact tools this market created for him, and most people never even open them.
